Terms and Conditions of Sales and Returns
The owner of the online store FUNKY.EE (hereinafter referred to as the Online Store) is OÜ Funky Events (registry code 16525242), located at Tiigi 1-27, Voka village.
Validity of the Sales Agreement, Product, and Price Information
The sales terms apply when purchasing goods from the Online Store. The prices of the products sold in the online store are indicated next to the products. In addition to the price, a fee for the delivery of the goods is added.
The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer when placing an order. Information about the product is provided directly alongside the product in the Online Store.
Ordering Process
To order goods, desired products must be added to the shopping cart. To complete the order, the required fields must be filled in and a suitable method of product delivery must be selected. Then, the screen displays the amount due, which can be paid via a bank link or another payment solution. The following payment methods are available:

Funky Events OÜ is the data controller for personal data. Funky Events OÜ transfers the necessary personal data for making payments to the authorized processor Maksekeskus AS. The agreement comes into force upon receipt of the amount due to the Online Store's bank account. If the ordered goods cannot be delivered due to the termination of the goods or for any other reason, the buyer will be notified at the earliest opportunity, and the paid money (including the delivery costs of the goods) will be refunded without delay, but no later than 14 days from the date of sending the notification.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland. Goods are delivered by AS Eesti Post (Omniva) and Itella SmartPOST. The buyer bears the costs of shipping, and the corresponding price information is displayed next to the shipping method. Domestic shipments generally reach the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract. Delivery outside of Estonia takes place within 14 calendar days. In exceptional cases, the right to deliver the goods is reserved for up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days. The right of withdrawal does not apply if the buyer is a legal person. To exercise the 14-day withdrawal right, the ordered goods must not be used in any way other than necessary to ascertain the nature, characteristics, and functioning of the goods in the same way as it would be allowed to test the goods in a physical store. If the goods have been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the goods, or if there are signs of use or wear and tear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods. To return the goods, a statement of withdrawal from the purchase of the goods must be submitted and sent to the email address info@funky.ee no later than 14 days from the receipt of the goods. The buyer bears the costs of returning the goods, unless the reason for the return is that the item to be returned does not correspond to what was ordered (e.g., wrong or defective item). The buyer must return the goods within 14 days following the submission of the withdrawal statement or provide evidence that the goods have been handed over to the carrier during the aforementioned period. Upon receipt of the returned goods, the Online Store refunds all fees received from the buyer under the contract immediately, but no later than 14 days from the receipt of the withdrawal notice. The Online Store may refuse to make refunds until it has received the item subject to the contract back or until the buyer has provided evidence of returning the item, whichever occurs earlier. If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery offered by the Online Store, the Online Store is not obligated to refund the cost exceeding the cost associated with the standard delivery method. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked down due to an error.
Right to Submit a Complaint
The Online Store is responsible for non-compliance with or defects in the goods sold to the buyer, which existed at the time of delivery and which appear within two years from the delivery of the goods to the buyer. During the first six months from the delivery of the goods to the buyer, it is presumed that the defect existed at the time of delivery. Rebuttal of this presumption is the responsibility of the Online Store. In case of a defect, the buyer has the right to contact the online store within two months by sending an email to info@funky.ee. The Online Store is not responsible for defects that occur after the goods have been delivered to the buyer. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer. The Online Store responds to consumer complaints in writing or in a form that allows reproduction within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer (including name, phone number, address, email address, bank details) only for processing the order and sending the goods to the buyer. The Online Store transfers personal data to companies providing transport services for the purpose of delivering goods. The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a desire to receive them by entering an email address on the website and indicating a desire to receive direct mail notifications. The buyer may opt out of receiving offers and newsletters by notifying us by email or by following the instructions provided in the email containing the offers. Dispute Resolution If the buyer has any claims against the Online Store, they must send them to the email address info@funky.ee. If the buyer and the Online Store fail to resolve the dispute by agreement, the buyer may turn to the Consumer Disputes Commission. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The examination of the buyer's complaint by the commission is free of charge. The buyer may also contact the European Union platform for online dispute resolution regarding consumer disputes.
